Terms of Service

These terms are the agreement between you and RETHINK AI ("RETHINK AI", "we", "us") for use of FunnelFab, the service at funnelfab.com and app.funnelfab.com. By creating an account or using the service you accept them. If you are agreeing on behalf of a company, you confirm you are authorised to bind it.

1. The service

FunnelFab lets you build, publish and host interactive marketing funnels and landing pages, capture enquiries from them, and send follow-up email. We may add, change or withdraw features over time. If we withdraw something you materially rely on while you are paying for it, we will give you reasonable notice.

2. Your account

• You must give accurate registration details and keep them current.
• You are responsible for what happens under your account, including anything done by workspace members you invite and by API keys you issue.
• Keep your password and API keys confidential and tell us promptly if either is compromised.
• You must be at least 16 years old to hold an account.

3. Your content and your leads

You keep ownership of everything you upload or create — your funnels, copy, images and the enquiry data your funnels collect. You grant us only the licence we need to host, process, back up and display that content in order to run the service for you.

You are responsible for the enquiry data you collect. That means having a lawful basis to collect it, giving the people who fill in your forms the notice and choices the law where they live requires, publishing your own privacy policy, and honouring their requests to access or delete their data. In relation to that data you are the controller and we act on your instructions.

4. Acceptable use

You must not use FunnelFab to:

• break the law, or infringe anyone's intellectual property or privacy;
• send unsolicited bulk email, or mail anyone who has not agreed to hear from you or who has unsubscribed;
• run phishing, impersonate a person or organisation, or publish deceptive claims or fake reviews and testimonials;
• publish malware, or attempt to breach, overload, probe or reverse-engineer the service or its security;
• collect payment card numbers, government identifiers, health records or other sensitive categories through funnel form fields;
• resell or white-label the service except under a written agreement with us.

We may suspend or remove content or an account that breaches this section. Where the breach is not serious we will try to warn you first.

5. Plans, billing and cancellation

• Paid plans are billed in advance, monthly or annually, through Stripe. Fees are stated at checkout and exclude taxes unless we say otherwise.
• Additional funnels beyond your plan's allowance are charged per funnel and prorated by Stripe when you add them.
• Subscriptions renew automatically until cancelled. Cancel any time from the billing screen; cancellation takes effect at the end of the period you have paid for.
• Payments are non-refundable except where the law requires otherwise or we agree in writing.
• If payment fails we may retry, and after a grace period we may stop serving your published funnels and eventually suspend the account. We will email you before that happens.
• We may change prices with at least 30 days' notice before your next renewal.

6. Third-party services

You may connect FunnelFab to services such as Google, Microsoft, Stripe or a CRM. Those services are governed by their own terms and privacy policies, not by these terms, and we are not responsible for what they do or for outages on their side. Connecting one authorises us to exchange the data that integration needs.

7. Availability

We work to keep FunnelFab available and quick, but we do not promise uninterrupted service. We may take it down for maintenance, and we may need to act at short notice for security. We do not offer a contractual uptime guarantee unless one is agreed separately in writing.

8. Suspension and termination

You may close your account at any time. We may suspend or terminate an account that breaches these terms, that we are legally required to act on, or that poses a security risk. On termination your right to use the service stops and your content may be deleted after a reasonable period — export anything you want to keep beforehand.

9. Disclaimers

Except where the law does not allow it, the service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will meet your requirements or that any specific commercial result — leads, conversions or revenue — will follow from using it.

10. Limitation of liability

To the fullest extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, goodwill or data. Our total aggregate liability arising out of or relating to these terms is limited to the greater of the amounts you paid us in the twelve months before the event giving rise to the claim, or one hundred United States dollars. Nothing here limits liability that cannot be limited by law.

11. Indemnity

You will indemnify and hold RETHINK AI harmless against third-party claims arising from your content, your use of the service, your handling of enquiry data, or your breach of these terms.

12. Changes to these terms

We may update these terms. We will revise the date above and, for material changes, give notice by email or in the studio before they take effect. Continuing to use FunnelFab after that means you accept the new terms.

13. Governing law

These terms are governed by the laws of the State of Arizona and the applicable federal laws of the United States, without regard to conflict of law rules. The state and federal courts located in Arizona have exclusive jurisdiction over any dispute arising out of or relating to these terms, and both parties consent to that jurisdiction and venue.

14. General

These terms, together with the Privacy Policy, are the entire agreement between us about the service. If a provision is found unenforceable the rest remains in force. Our not enforcing a right is not a waiver of it. You may not assign this agreement without our consent; we may assign it in connection with a merger, acquisition or sale of assets.
